Please read the following terms and conditions carefully before using this website. By using this website, you accept, without limitation or qualification, the Terms and Conditions set out below.
1. Validity
These terms and conditions govern Chic Banners relating to the sale and supply of goods to the customer. Chic Banners reserve the right to amend these terms and conditions from time to time by updating this text page; and the customer is bound by any such modifications or revisions.
2. Contract with Customer
The contract between Chic Banners and the customer comes into existence upon Chic Banners acceptance of the customers order i.e. when payment has been received. Chic Banners is entitled to withdraw from contracts in the case of obvious typographical or arithmetical inaccuracies appearing on the Chic Banners website.
3. Product Description
Chic Banners try to ensure that all of the items shown on the website are accurately represented however small variations in colour, typefaces and layout may be experienced in the finished product. Please note all colours on computers, phones etc are viewed RGB, large format printing uses four colours CMYK and therefore some colour shade variances can be experienced due to this.
4. Pricing and Availability
The prices of the goods are those specified on Chic Banners’ website. Orders are subject to availability. In the unlikely event that the goods are unavailable, the customer will be notified as soon as possible via Email. Price and availability information is subject to change without notice.
5. Delivery of Goods
Chic Banners will deliver the goods ordered to the delivery address supplied by the customer. Availability permitting, all orders paid for by credit card (Paypal) will be despatched within 1 working day after proof sign off (Saturday and Sunday being non working days). Orders paid for by cheque require 3 days for clearance and are then despatched in the same way. Despatch of goods constitutes fulfilment of contract.
6. Cancellations
In accordance with the Distance Selling Regulations regarding cancellation rights (Regulation 13) you cannot cancel your order if the supply of good(s) are made to your own specification, such as photo gifts, named and personalised products, once production of the product has already commenced. Returns are subject to the conditions of Clause 8.
7. Complaints
All complaints should be received within 48 hours of receipt of goods, and will be acknowledged within 2 working days. We will endeavour to resolve any complaints within 5 days and keep you informed during the resolution process. Please note that your right to return items to us in accordance with these terms and conditions is in addition to any other statutory rights you may have.
8. Returns/Warranty
If the goods delivered are not what the customer ordered, or are of incorrect quantity, or are damaged or defective (excluding hardware* and damage caused by client misuse), Chic Banners will, if the customer returns them within a reasonable period (5 working days), at the customer's option either give a full refund, or where possible, make good any shortage or non-delivery or replace any damaged or defective goods. Any damage caused by the courier/postal service should be advised IMMEDIATELY and photographic evidence forwarded of this to enable a claim to be made with the relevant third party involved. If you suspect damage may have occurred as the packaging is damaged/dented/bent etc should be noted on the delivery company's paperwork at time of receipt.
* Hardware is covered by the manufacturer's guarantee and any claims in this respect will be referred to the relevant party.
9. Governing Law and Jurisdiction
Contracts between Chic Banners and the customer will be governed by English Law and all disputes will be submitted to the non-exclusive jurisdiction of the English courts.
10. Disclaimer
Chic Banners hereby, to the fullest extent permitted by law, disclaims all warranties and conditions with regard to the Material and any goods and services supplied in relation to the website, whether expressed or implied or statutory (including all implied warranties and conditions of the merchant ability and fitness for a particular purpose). In no event that Chic Banners be liable for any indirect, punitive, special, incidental or consequential damages whatsoever even if Chic Banners has been advised of the possibility of damages including, without limitation, damages for loss of use, data or profits arising out of or in any way connected with the use or performance of this website, interruptions or delays to this website, the provision of or failing to provide services, or for any information, material goods and services obtained through this website or otherwise arising out of the use of this website, whether based on contract, tort or otherwise to the fullest extent permitted by law.
11. Privacy
Chic Banners is committed to protecting your privacy and all personal information collected during the order process will NOT be passed on to any third party.
